FOIA
The South Carolina Vocational Rehabilitation Department complies with all applicable provisions of the South Carolina Freedom of Information Act (FOIA). Under FOIA, any person may request to inspect, copy or receive any non-exempt public record of a public body.
However, it is unlawful for any person to solicit, disclose, or receive any information concerning applicants, consumers or former consumers of VR services without the written consent of the applicant or consumer. SC. Code §43-31-150. Such information is not a public record under FOIA and cannot be obtained by submitting a FOIA request.
Under the Family Privacy Protection Act, it is also unlawful for any person to obtain personal information from a state agency for the purpose of commercial solicitation. SC. Code §30-2-50.
FOIA allows for public bodies to establish and collect reasonable fees not to exceed the actual cost of the search, retrieval, and redaction of records. SCVRD may assess the following fees for FOIA requests and may require a deposit prior to searching for or copying any requested records:
Fee Schedule
- $15 per hour for search, retrieval, redaction, and/or transfer of records to electronic format
- $5.00 per disc
- $.30 per page Black and white- Letter size
- $.75 per page Color- Letter size
- $.40 per page Black and white - Legal size
- $ 1 per page Color - Legal size
Non-standard sizes and postage will be billed at the actual cost to SCVRD.
